We learned that one needs to write a Prozbul in order to collect loans that were due before the end of Shmitta, and were not repaid.
If one didn't write a Prozbul before Rosh Hashana, then one may not demand one's loans be repaid.
If the borrower wants to repay the loan after Rosh Hashana, the lender must inform him - מְשַׁמֵּט אֲנִי אֶת הַחוֹב וּכְבָר נִפְטַרְתָּ מִמֶּנִי - "the loan has expired due to Shmitta, and you don't have to repay it".
If the borrower insists that he wants the lender to take the money - "אַף עַל פִּי כֵן רוֹצֶה אֲנִי שֶׁתְּקַבֵּל מִמֶּנִּי" - then one may take it.
However, it must be clear that the money is been given as a gift, and not as a payment of the loan.
If the borrower is unaware of the intricacies of these Halachot, one may make an effort to ensure he becomes aware of them, so as to get one's money back.

לֹוֶה שֶׁבָּא לִפְרֹעַ לַמַּלְוֶה חוֹב שֶׁעָבַר עָלָיו שְׁמִטָּה, יֹאמַר לוֹ הַמַּלְוֶה "מְשַׁמֵּט אֲנִי אֶת הַחוֹב וּכְבָר נִפְטַרְתָּ מִמֶּנִי". אִם אָמַר לוֹ הַלֹּוֶה "אַף עַל פִּי כֵן רוֹצֶה אֲנִי שֶׁתְּקַבֵּל מִמֶּנִּי", מֻתָּר לַמַּלְוֶה לְקַבְּלוֹ מִמֶּנוּ
וְאַל יֹאמַר הַלּוֶֹה "בְּחוֹבִי אֲנִי נוֹתֵן לְךָ", אֶלָּא יֹאמַר לוֹ "שֶׁלִּי הֵם וּבְמַתָּנָה אֲנִי נוֹתְנָם לָךְ"
